Terms of service

These terms apply to services provided by DeMark, New Brunswick, Canada. A signed quote for a specific project may add to them; where the two differ, the quote wins.

Quotes and prices

Public prices on this site are starting prices in Canadian dollars, HST not included. Every project receives a written quote with a fixed price for a defined scope. The price only changes if the scope changes, and any change is agreed in writing before the extra work starts.

Payment

Projects are invoiced 50% on acceptance of the quote and 50% on delivery, unless the quote says otherwise. Monthly services are invoiced at the start of each month and can be cancelled with 30 days' notice. Invoices are due within 15 days.

Your content

You are responsible for the text, images and other material you give us, and for having the right to use them. We will never publish content that you have not approved.

Ownership

Once paid in full, the website, design files and source code produced for your project belong to you. Domain names, hosting accounts and third-party services are registered in your name from the start. Tools and libraries we license from others remain under their own licences.

Timelines

Estimated timelines depend on receiving your content and feedback in reasonable time. Delays on either side move the schedule; they never change the price.

Support and maintenance

Every launch includes 30 days of fixes for defects in our work. Ongoing updates, backups and changes are covered by the maintenance plan if you choose one, or billed hourly otherwise.

Liability

We do our work carefully and in good faith. Our liability for any claim is limited to the amount you paid for the service concerned. We are not responsible for losses caused by third-party services, by content you supplied, or by changes made by someone other than us.

Governing law

These terms are governed by the laws of New Brunswick and of Canada.
